By accessing or using Kept Shot (the 'Service'), whether as an event host, attendee, or visitor, you agree to these Terms. If you do not agree to these terms, please do not use the Service.
2. Description of the Service
Kept Shot provides a digital film camera experience for events and gatherings. Features include finite digital exposure allocation (film rolls), analog camera filters (Original, Vintage Film, Black & White), invitation covers and QR code generation, darkroom reveal mechanisms, host management vaults, and high-resolution photo archives.
3. Host Responsibilities & Account Security
As an event host:
- You must authenticate using a valid Google account.
- You are responsible for the distribution of event invitation links, QR codes, and managing access to your event vault.
- You agree that you have the requisite consent from your guests and attendees to collect and archive photographs from your gathering.
- You are responsible for all activities occurring under your event vault.
4. Guest Participation & Fair Use
As an event guest:
- You agree to choose a respectful display name that does not impersonate others.
- You acknowledge that each event provides a limited roll of exposures as determined by the host.
- You understand that photos taken during the event may be visible to the event host and, depending on the event settings, other invited guests.
- You will not attempt to bypass exposure counters, inject automated scripts, or tamper with camera upload endpoints.
5. Content Ownership & License
Your memories remain yours:
User Ownership
You retain full copyright and ownership of all original photographs you capture using Kept Shot.
License to Kept Shot
You grant Kept Shot a limited, non-exclusive, worldwide, royalty-free license solely to host, store, process, transform, and display your photographs for the purpose of operating the Service for you and your authorized event participants.
6. Prohibited Content & Conduct
You agree not to capture, upload, or share any photographs or content that:
- Is unlawful, defamatory, harassing, sexually explicit, abusive, or non-consensual.
- Infringes upon any intellectual property rights or privacy rights of any third party.
- Contains malicious code, viruses, or attempts to disrupt service infrastructure.
- Kept Shot reserves the right to remove any content or terminate access to any event that violates these standards.
7. Service Availability & Archival Storage
While we utilize high-reliability cloud infrastructure (Cloudflare R2 & Supabase), we do not guarantee permanent or indefinite photo storage. Hosts are strongly encouraged to download and back up their full photo archive ZIP once the event concludes.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Kept Shot and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, goodwill, or profits arising out of or in connection with your use of the Service.
9. Modifications to Terms
We may revise these Terms of Service from time to time. Updates will be posted on this page with an updated revision date. Continued use of Kept Shot constitutes acceptance of the modified Terms.
